Proposed Rulemaking for Revisions to Sex Discrimination Guidelines Released

Today, January, 28, 2015, OFCCP released the Notice of Proposed Rulemaking (NPRM) for the long awaited revisions to the Sex Discrimination Guidelines (RIN 1250-AA05).  The proposed changes are presented to align the guidance with laws, court decisions and societal changes since they were originally issued in 1970.

 

According to the OFCCP’s press release, the proposed rule addresses a variety of barriers to equal opportunity that many women face in the workplace today, including pay discrimination, sexual harassment, failure to provide workplace accommodations for pregnancy and gender identity and family caregiving discrimination.  OFCCP has also set up a page to provide specific information about the proposed rule here.

 

The NPRM is scheduled to be published in the Federal Register on Friday, January 30.  Contractors will have 60 days to submit public comment on the NPRM after it is published in the Federal Register.  Comments will be due March 31, 2015 if the NPRM is published on schedule.
